These Terms and Conditions ("Terms", "Terms and Conditions") govern your relationship with https://alitu.com website (the "Service") operated by Alitu Podcasting Ltd ("us", "we", or "our").
Please read these Terms and Conditions carefully before using the Service.
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.
By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.
Subscriptions
Some parts of the Service are billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis ("Billing Cycle"). Billing cycles are set either on a monthly or annual basis, depending on the type of subscription plan you select when purchasing a Subscription.
At the end of each Billing Cycle, your Subscription will automatically renew under the exact same conditions unless you cancel it or Alitu Podcasting Ltd cancels it. You may cancel your Subscription renewal either through your online account management page or by contacting Alitu Podcasting Ltd customer support team.
A valid payment method, credit card, is required to process the payment for your Subscription. You shall provide Alitu Podcasting Ltd with accurate and complete billing information including full name, address, state, zip code, telephone number, and a valid payment method information. By submitting such payment information, you automatically authorize Alitu Podcasting Ltd to charge all Subscription fees incurred through your account to any such payment instruments.
Should automatic billing fail to occur for any reason, Alitu Podcasting Ltd will retry the payment details held periodically over a 21 day period. If billing fails after this, your account will be suspended.
Free Trial
Alitu Podcasting Ltd may, at its sole discretion, offer a Subscription with a free trial for a limited period of time ("Free Trial").
You are required to enter your billing information to start your free trial period
The free trial will give you full access to our podcast maker software. You will only be able to create a maximum of 4 Episodes during the Free Trial period.
At the end of the trial period you will be charged and your subscription will be active. To avoid this you should cancel the subscription BEFORE the end of the trial period.
At any time and without notice, Alitu Podcasting Ltd reserves the right to (i) modify the terms and conditions of the Free Trial offer, or (ii) cancel such Free Trial offer.
Fee Changes
Alitu Podcasting Ltd may, at its sole discretion, offer a Subscription with a free trial for a limited period of time ("Free Trial").
You may be required to enter your billing information in order to sign up for the Free Trial.
If you do enter your billing information when signing up for the Free Trial, you will not be charged by Alitu Podcasting Ltd until the Free Trial has expired. On the last day of the Free Trial period, unless you cancelled your Subscription, you will be automatically charged the applicable Subscription fees for the type of Subscription you have selected.
At any time and without notice, Alitu Podcasting Ltd reserves the right to (i) modify the terms and conditions of the Free Trial offer, or (ii) cancel such Free Trial offer.
Refunds & Subscription Cancellations
Customers can cancel their subscription at any time. The subscription will remain active until the end of the “billing cycle” in which it was cancelled.
Money Back Guarantee
Alitu runs a “money-back guarantee” offer. Alitu will process a refund so long as the customer has cancelled their account within the “guarantee period”, which is usually a 30 day period. The guarantee period start date is the date of your first billing cycle which occurs after any “free trial” period.
For example:
Trial Start: 01st December
Trial end: 7th December
Billing Cycle start: 8th December
Billing Cycle end: 8th January
30 day money back "guarantee period" is: 08th December - 06th January.
No refunds will be issued for any reason if this is requested outside of the“guarantee period”.
Content
Our Service allows you to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material ("Content"). Alitu will not make any claim on your content.
You are responsible for the Content that you post to the Service, including its legality, reliability, and appropriateness.
By posting Content to the Service, you grant us the right and license to use, modify, perform, display, reproduce, and distribute such Content on and through the Service. You retain any and all of your rights to any Content you submit, post or display on or through the Service and you are responsible for protecting those rights.
You represent and warrant that: (i) the Content is yours (you own it) or you have the right to use it and grant us the rights and license as provided in these Terms, and (ii) the posting of your Content on or through the Service does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person.
Accounts
When you create an account with us, you must provide us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.
You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service.
You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
Our team may access your account dashboard, and view your content, if we're required to assist with support or technical issues that you experience, or if we have good reason to believe that you are violating our terms and conditions.
Intellectual Property
The Service and its original content (excluding Content provided by users), features and functionality are and will remain the exclusive property of Alitu Podcasting Ltd and its licensors. The Service is protected by copyright, trademark, and other laws of both the United Kingdom and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Alitu Podcasting Ltd.
Links To Other Web Sites
Our Service may contain links to third-party web sites or services that are not owned or controlled by Alitu Podcasting Ltd.
Alitu Podcasting Ltd has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that Alitu Podcasting Ltd shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.
We strongly advise you to read the terms and conditions and privacy policies of any third-party web sites or services that you visit.
Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service.
Limitation Of Liability
In no event shall Alitu Podcasting Ltd, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
Disclaimer
Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.
Alitu Podcasting Ltd its subsidiaries, affiliates, and its licensors do not warrant that a) the Service will function uninterrupted, secure or available at any particular time or location; b) any errors or defects will be corrected; c) the Service is free of viruses or other harmful components; or d) the results of using the Service will meet your requirements.
Governing Law
These Terms shall be governed and construed in accordance with the laws of United Kingdom, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.
Changes
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
File Retention & Backup
Alitu is not a file storage service, and you should always keep original copies of any files that you upload to Alitu, or record directly into the app. While we'll endeavour to keep your uploaded files active and ready for use, we can't guarantee that we'll retain them, permanently, and are not responsible for the safety of your original recordings.
Alitu will aim to store your uploaded files, and those you create in the app, for as long as you're an active paying member. If your subscription lapses, through cancellation or otherwise, then Alitu will delete your stored files 3 months after the date your paid subscription ends.
If you reactivate a paying subscription before the end of the 3 month period, then your files will continue to be stored. Again, please ensure you keep copies of your own files in the event that we're unable to store them for you.
Fair Use
Alitu offers unlimited use to many features, and aims to offer a great user experience throughout. We strive to offer a simple and transparent pricing system as a part of this. We don't charge extra costs when Alitu is used reasonably and normally. Your usage is all included within the base price. We do, though, need to make sure that the our services work fairly for everyone and with the best possible user experience. This means a great quality of service to every user, in a fair and distributed way.
To ensure that every user can access Alitu in an optimal way, we monitor technical usage and jobs done according to our Fair Use Policy. This policy has been put together to avoid improper use of Alitu's tools, so that we can offer all our customers an excellent user experience.
Call Recording
Call recording is currently unlimited in terms of usage. But, this is assuming that it's being used directly for podcast interview or episode recording, only. Not general calls. And it is intended for creating one show only, per user account. Here is our definition of the upper level of fair use, in terms of recording:
- Daily show - 5 days per week - 30 mins per episode = 10 hours recording per month
- Weekly show - 5 episodes per month - 2 hours per episode = 10 hours recording per month
In reality, the majority of weekly shows run 40 minutes to 1 hour, at most, so an average weekly show would tend to use 4 to 5 hours per month.
We monitor recording tool usage, and ask that users respect these limits. If you're regularly exceeding these limits, we'll get in touch to discuss our options. This may involve an extra cost to your service with Alitu.
Audio Processing
When you upload a recording, or create a recording directly in the app, Alitu does audio cleanup processing work on that file. This uses up server processing power. In normal usage we have plenty of resource to account for this, but we have monthly upper limits to ensure that any single user cannot use up an unfair proportion of server resources and disadvantage other users. The limits are as above, in the call recording example.
Daily shows, and weekly shows, would be expected to upload up to 10 hours per month, at an upper extreme. If you regularly go above this limit, we'll get in touch to discuss options. This may involve an extra cost to your service with Alitu.
In reality, the majority of weekly shows run 40 minutes to 1 hour, at most, so an average weekly show would tend to use 4 to 5 hours of uploads per month.
We monitor upload levels, and ask that users respect these limits. If you're regularly exceeding these limits, we'll get in touch to discuss our options.
Transcription Services
We use a third party transcription software service which is currently at no extra cost and Is included in the regular subscription rate.
In line with the audio processing and call recording there is an upper limit of 10 hours per month for the generation of transcripts.
If you are regularly going above the transcription limit then please get in touch with us to discuss options.
Higher limits may result in additional service cost with Alitu.
Alitu Music Library
Alitu provides a royalty-free music library for all customers with an active subscription. Customers can use the music from the library in their podcast episodes as long as that episode is published during their active subscription period.
If the customer cancels their Alitu subscription, they cannot use Alitu’s music in future episodes of their podcast. They do not have to remove Alitu’s music from episodes which were published during their active subscription period, but are prohibited from using it for new episodes.
Objectionable Content
Alitu has the right, but not an obligation, to review and subsequently delete any content on our systems that we determine, at our sole discretion, to be objectionable or offensive content, as defined below. Alitu also has the right, but not the obligation, to limit or close customer accounts for those customers who create such objectionable or offensive content, or engage in otherwise unacceptable activities on or through our platform.
You may not create or store materials on Alitu's platform which are unlawful, threatening, offensive, libellous, obscene, defamatory or otherwise objectionable. Examples of this type of objectionable content include, but are not limited to:
- abuse, harassment, threats or intimidation of any person or organisation
- taking part in, or contributing to, any kind of illegal activity
- taking part in, or contributing to, any activity that violates the rights of others
- the use of derogatory, discriminatory or racist language, or any language that could be described as hate speech
- creating or promoting content which could be harmful to others
- the use of speech, visuals, sounds or other content which denigrates or disparages others, or promotes denigrating or disparaging others.
